By using the GoDriver application and services, you agree to these Terms and Conditions. Please read them carefully. If you do not agree with any aspect, do not use our services.
1. Definitions
- Operator â PAN EXPRESS SRL, CUI RO14233022, Reg. Com. J40/8626/2001, IBAN RO24INGB0000999905753355 (ING Bank), cu sediul ÃŪn Str. Zinca Golescu, Nr.1a, Ap.1 Sector 6.
- Platform â the GoDriver mobile application and website.
- Customer â the user who requests transport or courier services.
- Driver/Courier â authorized individual or legal entity providing services through the platform.
2. Nature of the service
GoDriver is an intermediation platform between Customers and independent Drivers/Couriers. The Operator is not a carrier and is not a party to the transport contract concluded between Customer and Driver. The Operator only facilitates the connection, payment, and information flow.
3. Account creation
To use the platform, you must create an account by providing accurate and complete data. You are responsible for maintaining the confidentiality of your password and for all activities performed through your account. Accounts are strictly personal and non-transferable.
3.1. Requirements for Drivers/Couriers
- Authorized natural person (PFA) or legal entity
- Complete KYC documentation: trade register certificate, transport license, valid vehicle insurance, valid vehicle inspection
- Valid driving license of the appropriate category
- Acceptance of the electronically signed intermediation contract
4. Commissions, payments, and invoicing
The Operator charges a commission on the value of each ride, as per the intermediation contract signed by the Driver. Customer payments are processed through Stripe. Invoices are issued automatically by the platform on behalf of the Driver to the Customer and on behalf of the Operator to the Driver (for commission).
Payouts to Drivers are made according to the schedule defined in the intermediation contract. The Operator withholds taxes and social contributions only where there is a legal obligation to do so.
5. User obligations
- Provide accurate and up-to-date information
- Comply with applicable legislation (road traffic, tax, customs)
- Do not send packages with prohibited content (weapons, drugs, illegal materials, improperly perishable items)
- Behave civilly toward Drivers/Customers, without verbal or physical violence
- Do not use the platform for fraudulent purposes or to defraud the payment system
6. Account suspension and deletion
The Operator may suspend or delete an account in case of violation of these terms, abusive behavior, fraud suspicions, or upon request by authorities. The user has the right to delete their own account at any time â see Delete Account.
7. Liability and limitations
The Operator is not liable for: the quality of the service provided by the Driver, delays caused by traffic or weather conditions, damage/loss of packages (responsibility lies with the Driver per the transport contract), disputes between Customer and Driver. The Operator provides mediation assistance but is not obligated to indemnify.
The Operator's total liability to any user is limited to the value of commissions collected from that user in the last 12 months.
8. Intellectual property
All elements of the platform (code, design, logo, trademarks, content) are the property of the Operator or its licensors. Copying, modifying, decompiling, or redistributing without prior written consent is prohibited.
9. Applicable law and jurisdiction
These terms are governed by Romanian law. Any dispute that cannot be settled amicably shall be subject to the competent courts in Bucharest, Romania. Consumers may also use the European ODR platform: ec.europa.eu/consumers/odr.
10. Changes to the terms
The Operator may amend these terms. Significant changes will be communicated to you via email or in-app notification at least 15 days before they take effect. Continued use of the services after the effective date constitutes acceptance of the updated terms.
